Flynn Pardon, 5th Amendment & Judge Sullivan!

On Wednesday, Donald Trump pardoned his alleged co-conspirator Michael Flynn.
It is unclear if Trump’s pardoning of Flynn is legal. If the president conspires with another to commit a crime, his pardon would be providing cover for his co-conspirator to avoid prosecution and prison.
Moreover, Trump pardoning his co-conspirator, also acts as a self-pardon.
Trump now faces the fact that Flynn’s pardon removes Flynn’s right to plead the 5th Amendment. Therefore, hypothetically, Flynn could testify against Trump.
Meet U.S. District Judge Emmet Sullivan
The Flynn case has been turned into a national disgrace by both Trump and AG Bill Barr. It smacks of corruption. Barr appeared to try to manipulate America’s justice system to benefit one of Trump’s co-conspirators. His efforts were thwarted by Judge Sullivan. Judge Sullivan was the hero who forced Louis DeJoy to deliver the mail-in ballots.

The Washington Post wrote, “The long-awaited report from the Senate Intelligence Committee contains dozens of new findings that appear to show more direct links between Trump associates and Russian intelligence, and pierces the president’s long-standing attempts to dismiss the Kremlin’s intervention on his behalf as a hoax.”
Flynn Committed Felonies
To be clear, Flynn committed felonies. He pled guilty, twice. The court accepted his guilty pleas.
Guilty As Charged Flynn:
First, Flynn snuggled up to Russian officials behind the back of the sitting president—President Obama.
Second, Flynn undermined American/Russian policy.
Third, Flynn lied about it to American Intelligence officials.
Will Judge Sullivan Weigh In?
Two months ago, the Federal Appeals court ordered Judge Sullivan to dismiss the criminal case against Michael Flynn, who twice pleaded guilty to lying to the FBI.
In a shocking twist, Judge Sullivan refused to dismiss the case and asked the U.S. Court of Appeals for the DC Circuit for a rehearing en banc.
The goal of the full appellate panel was to apply the rule of law and prevent Barr from carrying out Trump's political agenda of dismissing the Flynn case.
Judge Sullivan won.
It remains to be seen if Judge Sullivan will take any further action against Flynn.
Barr Interfered and Deserves To Be Investigated
Barr’s DOJ sought to dismiss the criminal case against Flynn despite Flynn pleading guilty. This needs to be investigated.
Fun Fact: Flynn served as Trump’s former National Security Adviser. Flynn plead guilty in 2017 for lying to the FBI about conversations with Russian Ambassador Sergey Kislyak regarding Russian Sanctions.
Not only did Judge Sullivan asked why Flynn should not be held in contempt of court for Perjury. He appointed Federal Judge John Gleeson to argue against Barr and DOJ request to dismiss the Flynn case.
Judge Gleeson Accused AG Barr of Gross Abuse
Judge Gleeson was the Federal prosecutor who took down the Gambino and Colombo crime families - and locked up John Gotti.
In a stunning rebuke, Judge Gleason accused Barr’s DOJ of exercising a “gross abuse of prosecutorial power” to protect an ally of Trump, distorting known facts and legal principles to protect Flynn from a prison sentence.
Moreover, Judge Gleeson destroyed Barr’s handling of the Flynn case, describing it as an “irregular” effort that courts would “scoff” at if the defendant was anyone other than a Trump.
Flynn Will Be Remembered As A Traitor To His Country
So three years after pleading guilty, Flynn— a reported traitor, who compromised America’s national security, and then lied about it — now enjoys a pardon from Trump.
Will Trump’s Pardon Stand Up To Legal Challenges?
Trump’s pardon doesn’t protect Flynn from additional charges being filed against him. Moreover, it remains to be seen if Trump’s pardon will stand up to legal challenges.
Judge Sullivan raised concerns that Flynn may have lied under oath regarding the circumstances of his plea agreement. Therefore, he may explore further legal options against Flynn.
Crooked To The End
Rep. Adam Schiff Tweeted a strong response to Trump, “This time he pardons Michael Flynn, who lied to hide his dealings with the Russians. Donald Trump has repeatedly abused the pardon power to reward friends and protect those who covered up for him. It’s no surprise that Trump would go out as he came in — Crooked to the end.”
If nothing else, Trump’s pardoning of Flynn will stand as a reminder to ALL Americans that Trump colluded with Russia to interfere in the 2016 election.
