Flynn Lawyers Ask Appeals Court To Force Judge Sullivan To Grant Dismissal!
Judge Sullivan isn’t going to roll over for Bill Barr. He appointed Judge Gleason to argue perjury charges against Flynn.
Update: Michael Flynn’s lawyers are attempting to get the Apellate Court to force Judge Emmet Sullivan to dismiss Flynn’s case using a writ of mandamus.
This move smacks of desperation. It deserves to be summarily dismissed.
Judge Emmet Sullivan, the judge overseeing Michael Flynn's criminal case, is allowing people outside of AG Bill Barr’s Department of Justice to comment on the Trump administration’s effort to dismiss the case.
In an interesting move on Tuesday, Judge Sullivan said third-parties would be able to file what’s called a "friend of the court" a.k.a. amicus briefs in the Flynn case. Judge Sullivan announced this in response to the shocking request made to drop the Flynn case.
The request to drop the Flynn case was filed last Thursday by Acting U.S. Attorney for the District of Columbia Timothy Shea. Shea, acting on behalf of AG Barr and Trump, sought to dismiss the criminal case against Micheal Flynn despite Flynn pleading guilty.
As you may recall, Flynn served as Trump’s former National Security Adviser. Flynn plead guilty in 2017 for lying to the FBI about conversations with Russian Ambassador Sergey Kislyak regarding Russian Sanctions.
In an epic move, Judge Emmet Sullivan asked why Michael Flynn should not be held in contempt of court for Perjury. Moreover, Judge Sullivan has now appointed Judge John Gleeson to argue against AG Barr and DOJ request to dismiss the Flynn case. Judge John Gleeson was the Federal prosecutor who took down the Gambino and Colombo crime families - and locked up John Gotti.
It appears that Trump and Barr’s move to drop the charges against Flynn may have just backfired.
