Private investigators working for Rep. Eric Swalwell served the lawsuit that alleges Rep. Mo Brooks incited the January 6 Capitol riot.

Brooks is now claiming that he only gave the January 6 speech because Donald Trump asked him to, in his capacity as a U.S. Representative.

Recall that Ali Alexander, the “Stop the Steal” organizer, claimed after the January 6 Capitol attack that he plotted with three Republican members of Congress to organize the attack. He named Reps. Andy Biggs, Paul A. Gosar, and Mo Brooks.

Brooks notoriously hid from Rep. Swalwell for three months to avoid being served.

Swalwell has also filed a lawsuit against Donald Trump and Rudy Giuliani for their roles in the Capitol attack.

Last month, Brooks had a meltdown on Twitter after finally getting served with the lawsuit. Brooks claimed members of "Swalwell's team" broke into his home and served the lawsuit to his wife.

Brooks Tweeted, “@EricSwalwell Well, Swalwell FINALLY did his job, served complaint (on my WIFE). HORRIBLE Swalwell’s team committed a CRIME by unlawfully sneaking INTO MY HOUSE & accosting my wife! Alabama Code 13A-7-2: 1st degree criminal trespass. Year in jail. $6000 fine. More to come!”

Philip Andonian, an attorney for Swalwell, appeared on CNN to firm deny Brooks’ claims of unlawful entry stating, “No one entered or even attempted to enter the Brooks' house. That allegation is completely untrue. A process server lawfully served the papers on Mo Brooks' wife, as the federal rules allow.”

Andonian continued, “This was after her initial efforts to avoid service. Mo Brooks has only himself to blame for the fact that it came to this. We asked him to waive service, we offered to meet him at a place of his choosing. Instead of working things out like a civilized person, he engaged in a juvenile game of Twitter trolling over the past few days and continued to evade service. He demanded that we serve him. We did just that. The important thing is the complaint has been served and Mo Brooks can now be held accountable for his role in inciting the deadly insurrection at the Capitol.”

It should be noted that Brooks could have had his staff or attorney assist him in accepting the lawsuit but refused for months.

Brooks appeared to be using Trump-like tactics of dodging accountability for his actions while sowing seeds of chaos and division.

Brooks is actively campaigning to become Alabama’s next Senator. He is running ads that include portions of the speech he gave that allegedly helped Trump in incite the attack on the Capitol.

Recall that Brooks shouted to the rioters in front of the White House “today is the day American patriots start taking down names and kicking ass.”

According to the Intercept, Brooks also demanded the mob consider the American ancestors who sacrificed their blood and “sometimes their lives” to create the “greatest nation in world history.”

“So, I have a question for you,” Brooks continued. “Are you willing to do the same?” He then led the rioters in a chant shouting, “USA! USA!”

Brooks appears to be trying to have it both ways. He condemns the Capitol attack but uses his speech that incited the attack in multiple ads running on social media. Brooks continues to peddle baseless conspiracies of mass election fraud even though it is common knowledge that there was no widespread voter fraud.

Fun Fact: Mo Brooks blames Trump for his speech.

Brooks will finally be forced to answer questions about his role in inciting the mob to violence under oath.
